What is a Home Based Food Business?
A home based food business involves the preparation of food items in a domestic setting that are sold, examples of home-based food businesses include:
- preparing food for sale at markets in a domestic kitchen
- bed and breakfast accommodation
- home-based childcare for a fee involving the provision of food
- home-based catering businesses
- restaurants with accommodation for the restaurant owner, family or staff
Do I qualify for a Complying Development Certificate?
A Complying Development Certificate may be issued for a home based food business if the proposal meets all of the relevant development standards.
A Complying Development Certificate can be issued by Council or a Private Certifier. An application for a Complying Development Certificate must be submitted via the NSW Planning Portal.
You can use the State Environmental Planning Policy (SEPP) to check whether your proposal is complying development. It is important to read both the individual clause as well as the Part.
In the event that your proposal does not meet all the standards, a Development Application must be lodged.
Food Safety?
Like all food businesses, those based at home must comply with the relevant parts of the Food Standards Code, including:
- Standard 3.2.2 Food Safety Practices and General Requirements
- Standard 3.2.2A – Food Safety Management Tools
- Standard 3.2.3 Food Premises and Equipment
- Part 1.2 Labelling and other information requirements
