What is a Mobile Business?

A Mobile Business is a business that operates while on the move, rather than being tied to a fixed location. Mobile vendors can operate using a range of vehicle types, including trailers, carts, vans and food stands. Examples of mobile businesses include, but are not limited to, food and drink vendors, animal grooming, mobile saunas,

 Is Development Approval from Council required to operate a Mobile Business in the Snowy Monaro Regional Council LGA?

You may require development consent to operate the mobile business, depending on the location you choose.

Public Land

Development Approval is required for operation of a Mobile Business on Council or Crown owned/operated land. Approval would not be given a vendor to operate on Council land that was in direct competition with an established business in the same locality.

Mobile food and drink outlets operating on public land in conjunction with an approved event must be included into the application for such an event and be incorporated into the corresponding approval. An approval under section 68 of the Local Government Act 1993 may also be required.

Private Land

Under the Exempt and Complying Code SEPP a Mobile Business can operate on private land as a Temporary uses and structures. This doesn’t require council approval as long as it meets the requirement of Subdivision 1 – General Requirement for Temporary Uses and Structures - https://www.legislation.nsw.gov.au/#/view/EPI/2008/572/part2/div3/subDiv1

What are the Health related requirements to operate a Mobile Business?

A Mobile vender that is selling food or drink shall be operated in accordance with the Mobile Food Vending Guidelines. http://www.foodauthority.nsw.gov.au/_Documents/retail/mobile_food_vending_guidelines.pdf and will be required to provide Council with a food and drink premises notification form, this form can be found on Snowy Monaro Regional Council’s webpage under forms. Should the Mobile Food Van be providing potentially hazardous foods – then they will be required to ensure that there is a Food Safety Supervisors Certificate on site.
